Terms of Service

1. Who Can Use Nabi

You must be at least 18 years old, or have the consent of a parent or legal guardian, to create an account. By registering you confirm that all information you provide is accurate and that you will keep it up to date.

Nabi offers four account types: Buyer, Tailor, Model and Admin. Each type carries different permissions and responsibilities described in these Terms and the associated policies.

2. Account Security

You are solely responsible for maintaining the confidentiality of your login credentials. Do not share your password. If you suspect unauthorised access to your account notify us immediately at hello@nabi.studio. Nabi will not be liable for any loss arising from your failure to secure your account.

3. Posting Fees

Tailors and Models may be required to pay a one-time posting fee before publishing listings or modeling posts. This fee is set by Nabi, displayed clearly before payment and is non-refundable once paid. Posting fees are not charged per listing — they are a single activation fee per account tier.

4. Orders & Escrow

When you place an order on Nabi your payment is held in a secure escrow account managed by Paystack — it is not transferred to the tailor immediately. The sequence is:

• Buyer places order and payment is captured into escrow.
• Tailor is notified and begins production.
• Tailor marks the order as dispatched when it is shipped or ready for collection.
• Buyer confirms receipt in the Nabi app.
• Payment is released to the tailor. If the buyer does not confirm within the configured holding period the payment auto-releases.

Any dispute must be raised through the Nabi app before the escrow window closes so we can help mediate. We cannot freeze a release that has already occurred.

5. Fees & Pricing

Each order includes three charges shown transparently at checkout:

• Platform fee— Nabi's commission for facilitating the transaction.
• Service fee — covers customer support and dispute mediation.
• Payment processing fee — charged by Paystack for handling the transaction.

All prices on Nabi are quoted in Ghanaian Cedis (GHS) unless stated otherwise. Nabi reserves the right to adjust fee structures with reasonable notice to affected users.

6. Seller Responsibilities

Tailors and sellers are independent vendors, not employees of Nabi. By listing on the platform you agree to:

• Provide accurate descriptions, measurements and photos for every listing.
• Deliver items in the condition and timeframe advertised.
• Respond to buyer enquiries within a reasonable time.
• Comply with all applicable Ghanaian laws, including tax obligations on your earnings.
• Not accept payment outside Nabi for orders originating on the platform (off-platform transactions bypass buyer protection).

7. Prohibited Conduct

You must not use Nabi to engage in any of the following:

• Posting listings for prohibited items (see the Marketplace Policy).
• Uploading illegal, harmful or prohibited content (see the Content Policy).
• Harassment, bullying or hate speech (see the Community Guidelines).
• Impersonating another person or business.
• Creating multiple accounts to circumvent a suspension.
• Attempting to access, scrape or interfere with Nabi's systems.
• Manipulating ratings, reviews or like counts.

8. Intellectual Property

You retain ownership of any photos, designs and content you upload. By uploading you grant Nabi a non-exclusive, royalty-free licence to display and promote your content on the platform and in our marketing materials. You may revoke this by deleting the content or closing your account, subject to our data-retention obligations.

The Nabi name, logo and proprietary software are owned by Nabi Fashion Ltd. You may not use them without written permission.

9. Suspension & Termination

We may suspend or permanently close any account that breaches these Terms, without notice in serious cases (e.g. fraud, illegal content, harassment). You may close your account at any time through the app. Earned but unpaid vendor balances will be settled within 14 business days of account closure.

10. Liability

Nabi provides the platform and escrow service; the quality, fit and legality of bespoke items is entirely the vendor's responsibility. To the extent permitted by Ghanaian law, Nabi's total liability to you for any claim arising out of these Terms shall not exceed the total fees paid by you to Nabi in the 12 months preceding the claim.

11. Governing Law

These Terms are governed by the laws of the Republic of Ghana. Any disputes that cannot be resolved informally will be referred to the courts of Ghana.

12. Changes to These Terms

We may update these Terms as the service evolves. We will notify registered users of material changes by email or in-app notification. Continued use of Nabi after the effective date of an update constitutes your acceptance of the revised Terms.
